Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the I&C Pay Mobile Application ("I&C Pay" or “the App”) provided by Investment & Capital (I&C) Bank SAL, a bank regulated by the Central Bank of Lebanon, with its registered office at I&C Gate, Marfaa 128 Building, Foch Street, Beirut, Lebanon ("Bank", "we", "our", or "us"). By downloading, installing, accessing, or using I&C Pay, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Eligibility and Registration

To use I&C Pay, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction.
  • Have an active bank account with I&C Bank (“the Account”).
  • Register for mobile banking services by providing accurate and complete information.

Using the App

  • Subject to the terms and conditions of these Terms and any rules and policies applied by the relevant app store, you will be granted a limited, non-exclusive, non-transferable and revocable license to use the App. This license to use the App will terminate immediately when your Account is closed for any reason whatsoever.
  • You must not:
    • install or use the App on, or transfer the App to, anyone else’s mobile device;
    • use the App in any unlawful manner or in contravention of any term of this Agreement;
    • copy, modify, distribute, sell, lease, translate, adapt, vary, violate, circumvent, reverse-engineer, decompile, disassemble, create derivative works or otherwise interfere with the App (or any part thereof) or assist anyone else to do any of these things;
    • use the App on any illegally modified devices such as a jailbroken device, rooted device or any device that has been altered in any way whatsoever;
    • interfere with the access to and use of the App by other users and you shall not use the App for any purpose other than conducting authorized Transactions; or
    • hack into, attempt to hack, or gain unauthorized access, whether directly or indirectly, into other users’ App, for any purpose whatsoever by any virus, Trojan Horse, worms, macros, malicious programs or other harmful components or deleterious programs or files.
  • The Bank may update the App periodically to improve performance, add features, or address security concerns. You agree to install updates (or upgrade your phone’s operating system to the latest version available) as they become available. Failure to do so may result in limited functionality or termination of access. The Bank shall not be responsible for the performance of the App on your phone if you do not update the App or your phone’s operating system to the latest version available.

Scope and Fees

By using I&C Pay Application Services (“I&C Pay Services), you agree to comply with current Lebanese laws and regulations, these Terms and Conditions, Customer rights and duties and the terms and conditions governing your Account(s) at the Bank including the terms and conditions governing the use of Credit Cards (collectively referred to as “the Terms”). You agree also on the other terms and conditions stated on the I&C Pay Application or any related I&C Bank application screens. You will also be subject to the terms of the Bank’s service providers, including, but not limited to, your mobile service provider. You acknowledge having read and approved these Terms. You acknowledge that these Terms may include fees, limitations, and/or restrictions that may affect your use of I&C Pay. It is your responsibility to verify that you are entitled, under local laws and regulations, to access and/or use I&C Pay Services. The Bank cannot be held liable under any circumstances for any violation of local regulations.

Acceptance

By downloading I&C Pay, you register your intent to use the I&C Pay Services. Your authorization to use the I&C Pay Services is contingent upon the Bank’s determination that you have met all of its conditions, including the submission of necessary documents and information as required by the Bank from time to time. The Bank reserves the right, at its sole discretion and without justification, to reject your request to use the I&C Pay Services. The use of the I&C Pay Services is personal to you and may not be assigned to any other person. You agree and acknowledge, at your own risk and liability, that you are the holder of the Account(s) and the primary holder of the debit/credit card(s) required for accessing and using the I&C Pay Services. You must take all necessary measures to safeguard the Passcode, your key login to I&C Pay and the card and Personal Identification Number (PIN code) associated with it and assume full responsibility for any consequences arising from not keeping the Passcode and PIN code confidential, as well as for any use of the I&C Pay Services by any other person.

Description

The I&C Pay Services enable you to access account information using compatible and supported electronic mobile devices. The Bank reserves the right to modify the scope of the I&C Pay Services at any time. You acknowledge and understand that the I&C Pay Services may occasionally be inaccessible or have limited functionality. The Bank may, at its sole discretion, impose maximum limits on certain I&C Pay transactions, depending on the type of transaction and/or customer, and may set maximum daily or periodic limits per client. You hereby acknowledge and accept that you may be enrolled in the Bank’s SMS alert service and will receive SMS alerts on the Mobile Number you have designated when enrolling I&C Pay. You irrevocably waive your right to invoke the provisions of the Lebanese Banking Secrecy law against the Bank in this regards.

Accuracy of Information

You are solely responsible for the accuracy of the information provided to the Bank for the use of this App. The Bank accepts no liability for any consequences arising from erroneous information provided by you. If you notice an error in the information provided to the Bank, whether in the application form or any other communication, you must immediately notify the Bank. The Bank will endeavor to correct the error on a “reasonable efforts” basis wherever possible.

Nature of Information

The information provided on the App is for indicative purposes only. No representation or warranty, express or implied, is made by the Bank or any of its officers, employees, or agents regarding the accuracy or completeness of the information contained therein. The Bank accepts no responsibility or liability for any inaccuracies or omissions.

Security and Authentication

You are responsible for maintaining the confidentiality of your login credentials, including passwords, PINs, and biometric information. You agree to:

  • Not share your login information with anyone.
  • Notify the Bank immediately of any unauthorized access or use.
  • Log out of the App after each session.

The Bank shall not be liable for losses due to:

  • Unauthorized access caused by your negligence;
  • Jailbroken or rooted mobile devices;
  • Sharing of login details.

The Bank uses reasonable security measures to protect your information but cannot guarantee that unauthorized third parties will never defeat those measures, and you hereby acknowledge and accept the inherent risks of using electronic channels.

Hypertext Links and Viruses

The Bank explicitly states that it has no control over, and assumes no responsibility for, links to external sites. You must take necessary precautions to ensure that any sites accessed via links are free from viruses or other destructive components.

Payment or Transfers through I&C Pay

Subject to the Terms and any applicable laws and regulations, any payment or transfer made by you using the I&C Pay Services or its related card will be debited/credited to the relevant Account(s) after the Bank’s verification and acceptance, which shall be conclusive and binding upon you. Such payment/transfer will only be considered received by the Bank upon its crediting/debiting to the Account(s). The Bank reserves the right, at any time and without prior notice, to refuse or return any payment or transfer, in whole or in part, at its sole discretion. The Bank shall not bear any liability for not accepting any payment, including but not limited to those made in unaccepted currencies. You are liable for any transactions made contrary to the Terms and shall indemnify the Bank for any loss or damage caused by unauthorized use of the Card.

Limitation of Liability

Without limiting the above, the Bank does not represent or warrant that:

  • the use of I&C Pay or its content will be available or function without interruption, or that it will be free of errors, or that any errors will be corrected;
  • the use of the App or its content, including the browsing and downloading of any content, will be free of viruses, Trojan horses, worms, or other destructive or disruptive components; or
  • the use of this App or its content will not infringe the intellectual property or other rights of any third party. The Bank, including its affiliates, subsidiaries, suppliers, agents, advisors, and employees, will not, under any circumstances, be liable to anyone for:
    • any damage (direct, indirect, or consequential) related to the use of this App (including, without limitation, loss of use, loss of business, loss of data, loss of profits, and third-party claims);
    • any damage suffered as a result of the Bank’s failure or delay in accepting or processing a transaction or as a result of any failure attributable to any third party;
    • any losses suffered as a result of the operational failure, malfunction, interruption, change, amendment, or withdrawal of the I&C Pay Services, including but not limited to legal restraints, faults in the telecommunication network, or network failure, or any other reason beyond the Bank’s control;
  • delays or failure in performance, whether foreseeable or not, and/or any losses, expenses, or damage, howsoever arising, whether foreseeable or not, resulting from or due to any circumstances or causes whatsoever which are not within the Bank’s reasonable control. The Bank, including its affiliates, subsidiaries, suppliers, agents, advisors, and employees, will not, under any circumstances, be liable for any damage (direct, indirect, or consequential) arising from the use of the I&C Pay Services, including but not limited to:
    • any errors or omissions in the information provided;
    • any unauthorized access to or use of your account or data;
    • any interruption or cessation of transmission to or from the I&C Pay Services;
    • any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the I&C Pay Services by any third party;
    • any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the I&C Pay Services.

Privacy Policy

You hereby consent to the Bank's collection, storage, and processing of your personal information and all other information related to you in computer systems or other systems related to the electronic service. You herewith give your irrevocable consent for the Bank to share/disclose/exchange any information and/or data related to you and/or the Account(s) and any transactions associated with the Account(s) with the Bank’s subsidiaries, service providers, agents, banks, financial institutions, and regulatory authorities (collectively "third parties"), whether located within or outside of Lebanon; the Bank shall not be liable for any losses or damages resulting from the actions of said third parties. If you access the App from outside Lebanon, your data may be transferred to and processed in countries with different data protection laws. Although The Bank employs physical, electronic and procedural safeguards to protect your data, you acknowledge that no system can be completely secure and you shall also be responsible for protecting your device and login credentials.

Indemnification

You shall indemnify and hold the Bank harmless against all demands, claims, actions, losses, and damages of whatever nature, including financial losses, which may be brought against the Bank, or which the Bank may suffer or incur arising from: (i) our acting, or not acting, on any instruction made through I&C Pay or arising from or out of the malfunction, failure, or unavailability of any hardware, software, or equipment, the loss or destruction of any data, power failures, corruption of storage media, natural phenomena, riots, acts of vandalism, sabotage, terrorism, war, or other events beyond our control, interruption or distortion of communication links, or the reliance by any person on any incorrect, illegible, incomplete, or inaccurate information or data contained in any instructions received by the Bank; (ii) any loss or damage that may arise from the use, misuse, abuse, or possession of any third-party software, including, without limitation, any operating system software, browser software, or any other software packages or programs; (iii) any unauthorized access to the Account(s), any breach of security, any destruction of or access to your data, or any destruction of, theft of, or damage to any of your equipment; (iv) any loss or damage occasioned by the failure to adhere to any terms and conditions applicable to this App and/or by the provision of incorrect information, or loss or damage occasioned by the failure or unavailability of third-party facilities or systems or the inability of a third party to process a transaction.

Changes or Cancellation

You may cancel your participation in the I&C Pay Services by visiting the Bank’s Headquarters or sending an email in this respect. The Bank reserves the right to amend, change partially or completely, upgrade, add additional features to, or cancel the I&C Pay Services at any time without prior notice. Some services, particularly information services, may be partially or totally suspended on a temporary or permanent basis. Continued use of the I&C Pay Services constitutes acceptance by you of any such amendments. You acknowledge that, as laws change, certain additional information will be required by the Bank to remain in compliance and properly perform its duties in its relationship with you. You undertake to sign any requested document as required by the Bank to complete or update its files or otherwise comply with its legal obligations as per the applicable rules and regulations.

Fees and Charges

You acknowledge that the Terms may include fees, limitations, and/or restrictions that may affect your use of I&C Pay. Your mobile provider may impose data usage or text message charges for your interactions with the App, and you agree to pay all such fees. These fees and charges may include, but are not limited to, transaction fees, account maintenance fees, and service charges. The Bank reserves the right to modify these fees and charges at its sole discretion. By continuing to use the application after such changes have been made, you agree to the updated fees and charges.

Force Majeure

The Bank shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to:

  • Currency restrictions;
  • Government actions;
  • Cyberattacks;
  • Civil unrest, terrorism, war, riots, acts of vandalism, sabotage, economic instability, or natural phenomena.

Account Termination

The Bank reserves the right to terminate your Account(s) and access to the I&C Pay Services at any time, with or without cause, and without prior notice. Upon termination, you must immediately cease all use of the I&C Pay Services. Any termination of your Account(s) will not affect any of your or the Bank’s rights and obligations arising under the Terms prior to termination. You may also terminate your Account(s) by providing written notice to the Bank and settling any outstanding obligations. The Bank will process such termination requests in accordance with its policies and applicable laws and regulations.

Trademark and brand ownership

The trademark “I&C Pay” and all associated logos, designs, and slogans are registered trademarks of I&C Bank. The use of these trademarks is strictly prohibited without the express written consent of I&C Bank. Unauthorized use of the I&C Pay trademark or any related branding elements may result in legal action. All rights, titles, and interests in and to the I&C Pay trademark and brand are owned exclusively by I&C Bank.

Copyright

The Bank does not grant or transfer any intellectual property rights related to the I&C Pay Services to you. You acknowledge and agree that the Bank (or its licensors) retains all rights to the I&C Pay Services, and you are only permitted to use the I&C Pay Services as expressly authorized by the Bank. The Bank retains its copyright under Lebanese and International laws for the tools (software and hardware for accessing and using I&C Pay and I&C Pay Services), products, and associated documentation, including pictures, texts, logos, tables, iconographic and photographic representations, and documents, provided such tools, products, and documentation belong to the Bank. This also applies to any logos, trademarks, or service marks used. You shall not duplicate, reproduce, or tamper with the I&C Pay tools, products, and associated documentation without prior written consent from the Bank. Furthermore, you acknowledge that the use of third-party tools and/or products may be illegal in jurisdictions outside Lebanon and/or may infringe upon certain third-party intellectual property rights in such jurisdictions. You are responsible for ascertaining the legality of such use and obtaining all necessary licenses and permissions from the relevant parties if you use any third-party software outside Lebanon. You indemnify and hold the Bank harmless against any and all liability the Bank may incur in this regard.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of Lebanon and subject exclusively to Lebanese jurisdiction.
